Please read this Privacy Policy (this "Policy") carefully. Your access to and use of the Splashboards website, applications, and other tools that link to this Policy (collectively, the "Services") constitutes your acceptance of and agreement to comply with the practices described herein. If you do not agree with this Policy, you should not use the Services.

Splashboards Swim Analytics LLC ("Splashboards," "we," "us," or "our") is committed to protecting the privacy of the athletes, coaches, and other users of the Services. This Policy describes our practices regarding the collection, use, and sharing of personal information through splashboardswim.com and related applications that link to this Policy.

This Policy does not apply to information collected offline or through interactions with Splashboards outside of the Services, such as by telephone or email.

We reserve the right to modify this Policy at any time. If we do so, we will update the "Last Updated" date above. Please review this Policy periodically to remain informed of our current practices.

As used in this Policy, "personal information" means information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with a particular individual. We collect personal information as described below.

In connection with the creation of a Splashboards account, we collect your first and last name, email address, password, role (athlete, coach, or club), and the team with which you identify. The team field is self-reported and is not verified by Splashboards; it does not confirm actual team membership. We may also collect additional basic information, such as date of birth, and may introduce additional optional fields as the Services evolve.

Our Race Pace Calculator, Test Set Calculator, and Workout Builder require you to input data, including names, swim times, heart rates, and ages, in order to generate your results. Such information may pass through our servers for purposes of generating your results but is not retained thereafter. Because these tools require you to be signed in, this activity is associated with your account; however, Splashboards does not verify that the values entered correspond to actual individuals.

This product requires the upload of video footage of a swim. Splashboards personnel process such footage to generate a data report, including splits, stroke data, turn analysis, and related metrics. Uploaded video is retained for up to 12 months following processing — often for a considerably shorter period — after which it is deleted as part of a periodic data cleanup. Data extracted from your video is retained indefinitely unless you request its deletion.

By uploading video footage, you confirm that you are either the individual depicted in such footage or that you have obtained the permission of the individual depicted (or, where such individual is a minor, the permission of their parent or legal guardian) to share the footage with Splashboards.

Coaches and teams utilizing our Team Dashboard submit result files containing performance data regarding their athletes, which may include individuals under the age of 18. The coach or team submitting such information is solely responsible for confirming that they possess the necessary rights or consent, including parental or guardian consent where applicable, to share such information with Splashboards. Such data is accessible only to Splashboards and the submitting coach or team and is not made publicly available.

In connection with the purchase of a subscription or one-time product, billing information is collected through Stripe, our third-party payment processor. Splashboards does not directly collect or store your full payment card number.

Our hosting provider automatically logs certain basic technical information in connection with your use of the Services, including IP address, browser type, and timestamps, for purposes of operating and securing the Services. Splashboards does not currently employ analytics or advertising tracking technologies. Should this practice change, we will update this Policy and, where required by applicable law, obtain your consent.

We use personal information for the following purposes:

To create and manage your account

To operate the Splashboards tools, including the generation of calculator results, race analysis reports, and Team Dashboard views

To process payments

To communicate with you regarding your account or the Services

To maintain the security and integrity of the Services

To comply with applicable legal obligations

Splashboards does not sell or share your personal information with third parties for value.

We may share personal information under the following circumstances:

With service providers who assist in operating the Services, such as our hosting provider and payment processor

With coaches or teams, where you are an athlete whose data has been submitted to a Team Dashboard by your coach or team

For legal or safety purposes, including to comply with a subpoena or other legal process, to protect the safety of any individual, or to investigate a violation of our Terms of Service

Splashboards does not share your information for advertising or marketing purposes.

Calculator inputs (names, times, heart rates, ages): not retained following generation of your results

Race Analysis video: retained for up to 12 months following processing (often for a shorter period), after which it is deleted as part of a periodic cleanup

Race Analysis report data: retained indefinitely unless deletion is requested

Team Dashboard data: retained for as long as the submitting coach or team's account remains active, and indefinitely thereafter unless deletion is requested

Account information: retained for as long as your account remains active, and indefinitely thereafter unless you request deletion

Payment records: retained as required for accounting, tax, and legal purposes

Splashboards employs reasonable technical and organizational measures designed to protect your personal information. No method of transmission or storage is completely secure, and Splashboards cannot guarantee the absolute security of any information. You are solely responsible for maintaining the confidentiality of your password and for any activity occurring under your account.

Splashboards is not intended for use by individuals under the age of 18, and Splashboards does not knowingly permit individuals under the age of 18 to register for an account. Splashboards does not currently employ an age-verification mechanism at registration and relies on the accuracy of the information provided by the user.

Separately, a coach or team may submit performance data regarding athletes under the age of 18 through the Team Dashboard. In such circumstances, Splashboards relies upon the submitting coach or team to have obtained appropriate parental or guardian consent, or other applicable authorization, prior to sharing such information with us; Splashboards does not collect such information directly from the minor.

Should Splashboards learn that it has collected personal information directly from an individual under the age of 18 without appropriate consent, such information will be deleted as promptly as possible. If you believe this may have occurred, please Contact Us at [email protected].

Regardless of your state or country of residence, you may contact Splashboards to request a copy of the personal information we maintain about you, or to request its deletion, and we will make reasonable efforts to respond. Splashboards does not sell or share personal information for monetary or other valuable consideration.

California residents possess certain rights under California law, including the right to know what personal information has been collected, the right to request deletion, and the right to be free from discrimination for exercising such rights. The Services may contain links to third-party websites. Splashboards is not responsible for the privacy practices of such websites and encourages you to review their policies prior to providing them with any information.
